Your privacy is very important to us. We strive to offer our visitors the many advantages of Internet technology and to provide an interactive and personalised experience. 

This Privacy Policy is created to demonstrate our firm commitment to privacy and security. We collect information in different ways from visitors who access the various parts of our services and the network of Web sites accessible through our Service. When do we collect Information?

We collect information from you when you subscribe to a newsletter, fill out a form or enter information on our site. 

In our clinic, we capture most of the personal information relating to date of birth, height, weight, specific measurements, blood pressure and medical history at your initial assessment for the purposes of monitoring your progress through your wellness programme. 

When ordering or registering on our site, as appropriate, you may be asked to enter your name, email address, phone number or other details to help you with your experience. 

When you enrol in any of our courses, as part of the buying and selling process, we collect the personal information you give us such as your name, address, email address and in some cases date of birth. We do not hold credit card details or bank account details. 

When you browse our website, we also automatically receive your computer’s internet protocol (IP) address which may provide information that helps us learn about your browser and operating system. Aggregated Information (information that does not personally identify you) may be used in many ways. For example, we may combine information about your usage patterns with similar information obtained from other users to help enhance our site and services (e.g., to learn which pages are visited most or what features are most attractive). 

When you give us details over the phone, or subscribe to any of the mailing lists, with your permission, we will send you emails with information about health & wellness issues, along with news and information about ViVace. 

How we use your personal data? 

We act as a data controller for use of your personal data to provide direct healthcare. We also act as a controller and processor in regard to the processing of your data from third parties such as testing companies and other healthcare providers. We act as a data controller and processor in regard to the processing of credit card and online payments. 

We undertake at all times to protect your personal data, including any health and contact details, in a manner which is consistent with our duty of professional confidence and the requirements of the General Data Protection Regulation (GDPR) concerning data protection. We will also take reasonable security measures to protect your personal data storage. 

We may use your personal data where there is an overriding public interest in using the information e.g. in order to safeguard an individual, or to prevent a serious crime. Also where there is a legal requirement such as a formal court order. We may use your data for marketing purposes such as newsletters but this would be subject to you giving us your express consent. 

Consent

When you provide us with personal information to complete course enrollment, we imply that you consent to our collecting it and using it for that specific reason only. 

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If you complete our inquiry forms and consent to receiving information from us, your details will be added to our database and used for marketing and newsletters. 

How do I withdraw my consent?

If after giving consent for us to contact you, you change your mind, you may at anytime withdraw your consent. There will always be an Unsubscribe option in all our marketing mails which you can use at any time to unsubscribe from any further email receipt. Do you share my information with other organisations?

We will keep information about you confidential. We will only disclose your information with other third parties with your express consent with the exception of the following categories of third parties: 

  • Any contractors and advisors that provide a service to us or act as our agents on the understanding that they keep the information confidential 
  • Anyone to whom we may transfer our rights and duties under any agreement we have with you 
  • Any legal or crime prevention agencies and/or to satisfy any regulatory request, if we have a duty to do so or if the law allows us to do so. 
  • We may share your information with supplement companies and biochemical testing companies as part of providing you with direct healthcare. We will not include any sensitive information. 
  • We will seek your express consent before sharing your information with your GP or other healthcare providers. However if we believe that your life is in danger then we may pass your information onto an appropriate authority (such as the police, social services in the case of a child or vulnerable adult, or GP in case of self-harm) using the legal basis of vital interests.
  • Our professional body NTOI, for the processing of a complaint made by you 
  • We may share your case history in an anonymised form with our peers for the purpose of professional development. This may be at clinical supervision meetings, conferences, online forums, and through publishing in medical journals, trade magazines or online professional sites. We will seek your explicit consent before processing your data in this way. 

Third Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. 

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. 

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. 

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. 

We take confidentiality seriously and will not pass on or sell your data to anyone, unless there is a legal reason.

Age of Consent

ViVace.ie is not intended or designed to attract users under the age of 18. We do not collect Personal Information from any person we know to be under the age of 18. If you are under 18, we ask that you not send us any Personal Information.

We reserve the right to modify this privacy policy at any time. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been 

updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
